The CYRINE H. company (hereafter 'CYRINE H.') sells on its web site, cyrineh.com (hereafter, 'the Site'), models of products created or chosen by Mrs Cyrine Hayouni (hereafter referred to as 'the Products') and commercialized under the brand name Cyrine H.

Note that this English translation of the terms of use is provided for reference only.  For all legal purposes, only the French version of the terms of use posted on the Site is binding.

The following general terms of use define the modalities and conditions for online sale of  the Products presented on the Site by CYRINE H. to its clients.

All product orders by a client on the Site implies the client's full acceptance and without reservations of these general terms of use which are reproduced on the Site and to the exclusion of any other documents produced by CYRINE H.

Any other condition stated by the CLIENT will be unopposable to CYRINE H., no matter when CYRINE H. is given notice of it, unless full and express acceptance of this condition is given by CYRINE H..

Product information

The products for sale on the Site are most often accompanied by a text and/or photograph describing them so that before a firm order is taken, potential buyers know the essential features of the products they want to buy in conformance with article L111-1 of the Code de la Consommation.

CYRINE H. holds no responsibility for accidental errors in the descriptions of featured products.  The photos provided as illustrations are not contracts.  Colors are given on this site for information only and may be slightly different from those of ours products.  This does not give a client the right to refuse an order.

Order/offer acceptance process

To order, the CLIENT must first and obligatorily review these general terms of use.

The CLIENT must then add the selected article(s) to her or his shopping cart, and once done with selection, fill up a provided order form that includes the data necessary for identification of the client, in particular first and last name, postal delivery address, billing address, e-mail, and telephone numbers.

The sale is only sealed after the CLIENT has validated the order and paid the order total in full.

Automatic data recording systems will be regarded as giving evidence of  the nature, content and date of the order.

CYRINE H. reserves the right to cancel any CLIENT order with an unpaid prior order.

The buyer is bound by the data provided when the order is taken.

Price

The prices of products selected by the CLIENT are posted on the Site.  Prices are in Euros,  include all taxes, but do not include shipping fees.

Prices do not include customs duty fees that the CLIENT incurs on international orders.

The price shown on the validated order is final.  Prices shown on the Site can change at any moment and for any reason.

A paper copy of the invoice can be sent to the CLIENT on demand.

Payment

Online payment is with the following bank cards: CB, Visa, Mastercard.  Payment can also by made by check in Euros written to the order of  « Cyrine H. » and sent to:

Bank card data input is done on the www.cyrineh.com web site which uses a security system that scrambles and encrypts them as effectively as possible.

The CLIENT's bank card is only debited when an order is validated.

The CLIENT's validated order is only considered complete when the associated bank payment center has given approval.  If said center refuses, the order is automatically canceled and the CLIENT informed by e-mail.

Shipping

The products are only offered provided stock is available.

CYRINE H. systematically sends the CLIENT e-mail to confirm the reception of an order and to provide shipping delays.

Shipping is done by La Poste Colissimo.

Unless explicitly stated on the Site, delays provided to the CLIENT are averages and can vary with destination;  they are given for information only and CYRINE H. is not liable in case of further delays.   A tracking number is provided upon request.

Once an order is validated, CYRINE H. shall not be held responsible in case of product availability or shipping delay errors,  but the CLIENT then has the option to cancel the order.

As soon as an order is validated, risk is transfered for the ordered products from CYRINE H. to the CLIENT; the ordered products will thus travel at the CLIENT's own risk even in case of sending or return of postage-paid products.

Returns

A CLIENT has 7 business days to return an order, starting from the date the order was received.

The product must be returned in perfect condition, in its original packaging, and along with all associated accessories, manuals and documentation to the following address : Cyrine H - 1, rue de Meudon, 92130 Issy-les-Moulineaux, France.

In exchange, in case of return within the allowed period,  CYRINE H. shall reimburse the CLIENT or exchange the article; shipping fees remain the CLIENT's responsibility.

If a shipped product does not conform to the order or is defective,  CYRINE H. shall exchange or reimburse the CLIENT for the shipping fees and pay for the shipping of a replacement product.

Liability

CYRINE H. shall not be held responsible for non execution or poor execution of an order due to an event beyond the control of CYRINE H.

The products listed on the Site conform to current French law.  CYRINE H. is not liable in case of product non-conformance to the laws of another country it might be delivered to.

The selection and purchase of a product are fully the CLIENT's liability with no prejudice with regards to dispositions pertaining to resiliation and latent defect guarantees.

CYRINE H. is not liable for malfunctioning of the Site and/or the software used on the Site or obtained from there, data loss, delayed service, transmission failure, poor transmission, and service interruption, correctness, quality or nature of the data received by services, for consequences of any of the above, damage resulting from viruses transmitted by servers, loss of profit, indirect losses resulting from your use of the Site or your lack of access to it.

The CLIENT however benefits from the legal garantees of conformity and of latent defect, according to the articles L211-1 to L211-12 of the 'code de la consommation' and to the articles 1641and 1649 of the 'code civil'.

These guarantees are only honored when the product invoice is presented.

Applicable law and conflict resolution

This contract is subject to French law.
